These General Terms of Use and Contracting (hereinafter, the “General Terms”) govern access to and use of the website accessible through the domain name www.granmadrid.com and its subdomains (hereinafter, the “Website”).

Simple access to the Website confers the status of user (hereinafter, the “User”) and implies acceptance of all the terms included in these General Terms. If the User does not agree with these General Terms, they must refrain from carrying out any ticket purchase transaction through the Website.

By accepting these General Terms, the User declares that:

That they have read, understand, and comprehend the information set out herein.
That, in the event they proceed to contract any product and/or service, they have sufficient legal capacity to do so.
That they assume all obligations set out herein.

In compliance with the provisions of Article 10 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, the following general information about the Website is provided below:

Access to the Website is free of charge, except for the cost of the connection through the telecommunications network provided by the access provider contracted by the User, which shall be borne by the User.

The User agrees to use the Website and all its content and services in accordance with the law, morality, public order, and these General Terms, and shall not use them to carry out unlawful or criminal activities, or activities that infringe the rights of third parties and/or violate any applicable legal regulations.

Access, browsing, use, hosting and/or downloading of materials and/or use of the services of any GRANMADRID.COM website and/or content by minors (under 18 years of age) is strictly prohibited.

The User represents and warrants that they are at least 18 years old. The Website is exclusively reserved for adults. However, GRANMADRID.COM cannot verify the accuracy of the information provided and shall not be held responsible for minors who access the Website in breach of this condition of access. GRANMADRID.COM recommends that parents, guardians or legal representatives supervise or take appropriate precautions during minors’ Internet browsing, as well as set filters on the information and content that minors may or may not access.

GRANMADRID.COM offers you the following ticket purchasing option:

Website with an online purchase service available 24 hours a day, every day of the year. During the purchase process, and always before its completion, the User will have access to all information regarding the total final price, including taxes, breaking down, where applicable, any applicable increases or discounts and any additional charges passed on to the User. The User is responsible for providing accurate information, including personal data and the bank details required by the system.

Event organisers determine the conditions of the tickets and the event to which they grant access and provide GRANMADRID.COM with tickets for sale to the public through different distribution channels, including the Sales Channels.

Access to the event will be granted upon validation of the ticket and compliance with the Casino access requirements (the “Organiser”), and access will not be permitted to prohibited or self-excluded individuals or minors, with the Organisation reserving the right of admission in all cases.

In accordance with applicable regulations, all attendees must present at the Organiser’s reception the following valid identification document in force in order to access the Casino:

1. Spanish citizens: National Identity Document (DNI).
2. Foreign citizens:
   
   1. Passport.
   2. In the case of EU citizens: valid identification documents from the country of origin with a photograph.
   3. Official Spanish identification documents (residence card or foreigner identity card).

Entry and/or stay at the event is restricted to any person who:

1. Is under the influence of alcohol, carries or consumes any type of narcotics or illegal substances.
2. Carries weapons or any blunt, sharp or potentially dangerous objects that may cause harm to people and/or property.
3. Causes or incites any disturbance within the event or has caused confirmed disruptions.
4. Wears or displays any type of clothing that could incite hatred or violence.

All attendees may be subject to a security search upon entry to the event, and refusal to comply will result in denied access.

Regarding tickets:

1. Any damaged ticket or ticket showing signs of falsification will authorise the Organiser to deny access to its holder.
2. The Event Organisation is not responsible for stolen tickets.
3. The Organisation does not guarantee ticket authenticity unless purchased through official sales points.
4. It is prohibited to use tickets for raffles or any type of promotional activity without prior written authorisation from the Organiser.
5. It is strictly prohibited to record, broadcast and/or film the event with professional equipment without prior permission from the Organiser.

The Organiser may record, broadcast and film attendees. Attendance at the event implies authorisation for such use, which shall be the independent responsibility of each media/data processing entity.

For attendees at the event, it is strictly prohibited to record, broadcast and/or film the event without prior permission from the Organisation.

GRANMADRID.COM acts solely as an intermediary in the sale of tickets for shows and/or events organised by third parties and therefore exercises no control over the events or ticket availability. Any claim regarding the execution, suspension, modification or cancellation of the contracted event must be addressed to the organiser, together with presentation of the ticket.

The Website may contain technical linking devices, directories, and even search tools that allow the User to access other Internet pages and portals (hereinafter, the “Linked Sites”).

In no case does the existence of Linked Sites imply the formalisation of agreements between GRANMADRID.COM and the persons responsible for or owners of such sites, nor does it imply any recommendation or endorsement of the Linked Sites and/or their content by GRANMADRID.COM.

Unless expressly stated otherwise on the Website, GRANMADRID.COM has no knowledge of the content and services of the Linked Sites and therefore accepts no responsibility for any damage that may arise from their unlawfulness, quality, lack of updates, unavailability, errors, or lack of usefulness for the User or any third party.

However, GRANMADRID.COM will make its best efforts to prevent such circumstances, as well as to remove any linked site as soon as it becomes aware of them. If the User believes that a Linked Site contains unlawful or inappropriate content, they may notify GRANMADRID.COM, although such notification shall not in any case oblige GRANMADRID.COM to remove the corresponding link, which remains at its discretion.

All content on the Website, including but not limited to texts, photographs, graphics, images, icons, technology, software, links, and other audiovisual or sound content, as well as its graphic design and source code, is the intellectual property of GRANMADRID.COM or of third parties, and shall not be understood as granting the User any exploitation rights recognised under current intellectual property laws.

The trademarks, trade names, or distinctive signs published on the Website are the property of GRANMADRID.COM or third parties, and no rights over them are transferred to the User.

GRANMADRID.COM does not represent the owners of the trademarks of the products it markets.

8.1. Main characteristics of the shows and/or events

The main characteristics of the shows and/or events offered by GRANMADRID.COM can be consulted on the Website in the descriptive information provided for each event.

8.2. Contract. Order of precedence

The purchase of tickets is governed by these General Terms and by any special terms and conditions that may be published on the Website and specified in the purchase confirmation email.

In the event of a conflict between the aforementioned documents, any discrepancy shall be resolved, where necessary, according to the following order of precedence: (1) the special terms and conditions indicated in the purchase confirmation email, (2) the terms and conditions of the organisers, promoters, event and/or venue, and (3) these General Terms (hereinafter collectively, the “Contract”).

The User may formalise the Contract in Spanish (Castilian), as well as in other languages when such option is available. In case of discrepancies between the Spanish version and any other language version of the Contract, the Spanish version shall prevail.

8.3. Access to Purchase and Registration

For each ticket purchase, the system will indicate whether registration is required.

Access without registration: To make a purchase without registering, the User must identify themselves only with a valid email address. In this case, the data provided during the ticket purchase process will not be stored as registered user data; however, it will be processed in accordance with personal data protection regulations as set out in the Privacy Policy, to which the User expressly consents.

The User must complete the form, providing at least the data marked as mandatory with an asterisk, and expressly accept the Privacy Policy and cookie consent. All data entered by the User must be accurate, up to date, and truthful.

The User will receive a registration confirmation email at the provided email address.

8.4. Purchase confirmation and ticket collection

If the purchase process is completed successfully, the purchase will be confirmed on screen, providing a booking reference number.

The reference number uniquely identifies the User’s purchase and allows GRANMADRID.COM staff to identify the purchase in case of any enquiry.

Additionally, the User will receive a purchase confirmation email at the provided email address. Tickets may be downloaded from the confirmation screen and/or from the purchase confirmation email.

Furthermore, for each event, the ticket collection process will be as follows:

Ticket collection: in this case, it is essential that the User presents the information sent in the purchase confirmation email (booking reference or order number). Ticket collection at reception may be made up to the day of the event or show, and always during opening hours.

Tickets will be collected at:

• • Reception in the case of concerts.
  • French cash desk in the case of poker tournaments.
  • Mandalay entrance in the case of boxing championships.

8.5. Payment procedure

During the purchase process, the User must provide the required details and select one of the available payment methods. The ticket purchasing system uses a secure server and the latest encryption technology.

Purchases may be subject to security checks. The transaction may be cancelled by GRANMADRID.COM if it does not pass the verification process.

8.6. Price and additional charges

The prices indicated for each ticket include, unless expressly stated otherwise, Value Added Tax (VAT), applicable direct taxes, and are expressed in Euros (€).

Unless expressly stated otherwise, these prices do not include delivery costs (if tickets are sent by courier), cancellation insurance, or any other additional or ancillary services related to the tickets. These additional costs will be clearly indicated to the User during the purchase process and in any case before its completion.

The User must ensure, before completing the purchase, the accuracy and correctness of the data entered, as it is not possible to refund tickets once the purchase has been completed. Being unable to attend the event or making a mistake when purchasing tickets are not valid reasons for a refund.

Tickets may only be cancelled in the event of possible technical or operational issues attributable to GRANMADRID.COM.

In this regard, the User may not exercise the right of withdrawal or termination provided for in Article 103 of Law 3/2014, of 27 March, amending the consolidated text of the General Law for the Protection of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of 16 November, as such right is excluded in these cases.

GRANMADRID.COM will respond to complaints received as soon as possible and, in any case, within a maximum period of one month from the submission of the complaint.

If any clause included in these General Terms is declared wholly or partially null or ineffective, such nullity or ineffectiveness shall only affect said provision or the part thereof that is null or ineffective. The remaining provisions of these General Terms shall remain in full force and effect, and the affected clause shall be considered as not included, either in whole or in part, as applicable.

GRANMADRID.COM reserves the right to modify at any time the presentation, configuration and location of the Website, as well as the content and the conditions required to use it.

In the event of any discrepancies between the General Terms and their English version or any other language versions, the Spanish version shall prevail.

The aspects relating to the processing of users’ personal data in connection with the use of the Website are governed by the GRANMADRID.COM Privacy Policy, which has been provided to the User during the purchase process. This Privacy Policy forms an integral part of these General Terms, and GRANMADRID.COM has requested the User’s express consent for it.

These General Terms shall be governed by and interpreted in accordance with Spanish law, including, among others, Royal Legislative Decree 1/2007 of the General Law for the Protection of Consumers and Users, and Law 34/2002 on Information Society Services and Electronic Commerce.

In the event of a dispute between GRANMADRID.COM and the User, the User may bring legal action before the Spanish courts corresponding to the registered office of GRANMADRID.COM, or before the courts of the place where the User is domiciled.
